End-User License Agreement ("Agreement")

Please read this End-User License Agreement ("Agreement") carefully before clicking or selecting the "I Agree" button or box, downloading or using a digital product or license ("Application") offered by Digital Trybe, LLC ("we", "us", or "our").
By clicking or selecting the "I Agree" button or box, downloading, or using the Application, the end user ("you") is agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not click on the "I Agree" button or lick the box and do not download or use the Application.
License
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement. "Commercial use" means you are allowed to use the Application for your customers' projects for the benefit of their businesses. Commercial use is only authorized if you purchased an "Agency Developer" or "White Label" license which grants the right to use application for commercial purposes, and are provided a certificate granting such a license. If granted an Agency Developer or White Label license, you agree to be bound by the additional terms, exclusions, and limitations contained within the Agency Developer or White Label license certificate.
Restrictions
You agree not to, and you will not permit others to:
a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.
Modifications to Application
We reserve the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
Term and Termination
This Agreement shall remain in effect until terminated by you or us.
We may, in our sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from us, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device, website, server, and from your desktop.
Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device, website, server, and your desktop. Even if you terminate this Agreement, you shall be obligated to continue to pay for the license for the remainder of the term for which you originally agreed to. You are responsible for contacting us to request cancelation of your subscription payment prior to its next due date.
Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Limitation of Liability
We make no guarantees regarding the usability of the products you purchase. You agree that we shall not be liable for any damages incurred by you as a result of the use of our products beyond the original purchase price of the Application which was paid by you. In addition, you agree that we shall not liable for any damages your customers they, or you, incur as a result of you using our products in their projects, regardless of whether it was for commercial purposes or non-commercial purposes.
Amendments to this Agreement
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least thirty days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
